1. Agreement
By downloading or using Companion Waves, you agree to these Terms of Use. If you do not agree, do not use the app. Your use is also subject to the Apple Standard End User License Agreement, unless a different license is displayed by Apple for the app.
2. Purpose of the app
Companion Waves provides generated stereo tones, binaural-beat presets, and metronomes for personal wellness and productivity listening. Preset names describe intended listening contexts, not verified medical or performance outcomes. Individual experiences vary.
3. Not medical care
The app is not a medical device or health-care service and does not diagnose, monitor, treat, cure, or prevent disease or any other condition. It is not a substitute for medical advice, diagnosis, treatment, sleep care, hearing care, mental-health care, or emergency services. Consult a qualified professional before use if you have a hearing, neurologic, psychiatric, sleep, or other condition that may be affected by sound.
4. Safe use
You are responsible for choosing a safe volume, environment, duration, and audio device. Never use Companion Waves while driving, cycling in traffic, operating machinery, supervising a hazardous activity, or whenever reduced awareness could put anyone at risk. Stop listening if you experience pain, dizziness, disorientation, nausea, headache, ringing in the ears, hearing changes, anxiety, or other adverse symptoms. Review the Safety Guide before listening.
5. Limited license and acceptable use
Subject to these terms and the applicable Apple license, you receive a personal, limited, non-exclusive, non-transferable, revocable right to use the app on supported Apple devices you own or control. You may not reverse engineer, redistribute, resell, rent, sublicense, interfere with, or misuse the app except where applicable law expressly permits.
6. Other audio and services
If you mix Companion Waves with audio from another app or service, you remain responsible for following that service’s terms and for having any necessary rights to the other content. Companion Waves does not supply, copy, download, or license third-party audio.
7. Availability and changes
Features may change as the app is improved. Audio playback can be interrupted by calls, system events, other apps, battery state, operating-system behavior, or connected-device changes. The developer does not guarantee uninterrupted operation, compatibility with every accessory, or a particular listening result.
8. Disclaimer
To the maximum extent permitted by law, the app is provided “as is” and “as available,” without warranties beyond those that cannot legally be excluded. Nothing in these terms limits mandatory consumer rights that apply to you.
9. Limitation of liability
To the maximum extent permitted by law, the developer is not liable for indirect, incidental, special, consequential, or punitive loss arising from use of or inability to use the app. This limitation does not apply where liability cannot legally be limited.
10. Termination
Your permission to use the app ends if you materially violate these terms. Provisions that by their nature should continue—such as intellectual-property, disclaimer, and liability provisions—survive termination.
11. Governing law
These terms are governed by the laws of the Philippines, without depriving you of mandatory protections available under the law of your place of residence.
12. Changes to these terms
These terms may be updated when the app, applicable law, or distribution requirements change. The effective date above will be updated when revised terms are published.
